Direct Sales for Cultivators

  • Tiers 1-3 Outdoor, and Mixed, and Tiers 1-2 Indoor Cultivation License Types may directly sell cannabis flower the cultivator principally produced themselves, and manufactured cannabis products which were manufactured by any tier of Manufacturing License Type from cannabis flower principally produced by the cultivator themselves, to consumers beginning on November 1, 2023.

  • The Vermont Cannabis Control Board must articulate scale appropriate regulations for on-site, delivery, and off-site direct sales for these cultivation tiers related to: security, compliance, sales to minors, tracking, etc. These regulations must be: affordable, accessible for cultivators and consumers, and substantially lesser than the requirements for a Cannabis Retail License Type. The CCB must issue draft rules for direct sales of principally produced products by these tiers within 90 days of the legislation’s passage. The CCB, stakeholder cannabis establishments, and appropriate not-for-profit membership based organizations shall be consulted to determine what additional resources are needed by the CCB and community in order to support a successful direct sales marketplace.

  • Tiers 1-5 Outdoor, Mixed, and Indoor Cultivators may purchase, possess, and sell cannabis products wholesale which were manufactured by any tier of Manufacturing License(s) from cannabis flower principally produced by the cultivator themselves.

  • Tiers 1-3 Outdoor, and Mixed, and Tier 1-2 Indoor Cultivation License Types may directly sell seeds and immature plants, male and female, the cultivator principally produced themselves to consumers beginning on November 1, 2023

Direct Sales for Manufacturers

  • Tiers 1-2 Manufacturing License Types operating with less than $2 million in gross sales may directly sell the cannabis products which they participate in the production of themselves.

  • The Vermont Cannabis Control Board must articulate scale appropriate regulations for on-site, delivery, and off-site direct sales for these Manufacturing License Type tiers related to: security, compliance, sales to minors, tracking, etc. These regulations must be: affordable, accessible for cultivators and consumers, and substantially lesser than the requirements for a Cannabis Retail License. The CCB must issue draft rules for direct sales products produced by Tiers 1-2 Manufacturers who fall under the gross income threshold within 90 days of the legislation’s passage. 

Tying It Together

  • Direct sales of principally produced cannabis products from Tiers 1-3 Outdoor, and Mixed, and Tier 1-2 Indoor Cultivation License Types, and product produced directly by qualifying Tier 1-2 Manufacturing Licenses themselves shall not be regulated as a Retail License Type, and as such are not required to be approved by municipal vote / “Opt In” or to follow any other regulations specific to that license type.
